Terms of Use
These “Terms of Use” are entered into by and between you and Terre des Hommes Netherlands (“TDHNL” “we” “us”). The following terms of use govern your access to and use of the digital platform through the website and mobile applications with its pages, features, and content that we own or manage (collectively referred to herein as the “digital platform”) as a registered user.
Please make sure to read this carefully, by using the Voice for Change platform, you consent to be bound by these terms. If you are below 10 years of age or do not want to agree to these terms of use, you must not access or use the digital platform. Please have your parent or guardian with you to agree to the following terms if you have not reached the age of 18 years old.
1. The Purpose of the Voice for Change digital platform
The digital platform aims to create a network for empowered children and youth to advocate and raise their voices for awareness in their communities with issues concerning them.
2. Using the digital platform
a. Who can use it? This app is for children and young people from 10 years old and up. If you are under 17, your parent or legal guardian will also need to sign this agreement.
b. Registration. When you set up a profile in the Voice for Change platform, you will be asked to provide non-personal information about yourself. You still agree to provide us accurate information when you create your account. Part of our security procedure is approval of your registration by a web manager. You agree to notify us immediately of any unauthorized access to or use of your user name or any other breach of security. You also agree to ensure that you log out of your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or use your account. The digital platform also does not support iOS users, you can use the website instead.
c. Privacy Guidelines – By using the Voice for Change digital platform, you agree to accept our VFC Digital Platform Privacy Guidelines.docx.pdf. Our privacy guidelines cover your interactions with others on the platform.
d. Your contents
In the pursuit of child-friendly and safe space, all contents posted, uploaded and displayed to the platform are subject to the terms and conditions of this agreement. You may still edit or delete your posts and comments at any time from the digital platform. We reserve the right to remove or disable access to any user content (posts, comments and external links) that, at our sole discretion, do not follow our terms of use and privacy policy. We will remove posts, comments and external links that constitute or include cyberbullying, hate or any discrimination in whatever form on the grounds of gender, sex, age, race, ethnicity, skin colour, disability, health, sexual orientation, gender identity, social group, religious belief, political belief, social background, wealth or nationality.
You acknowledge that Voice for Change digital platform may preserve your posts or content and may also disclose your posts or content and related information if required to do so by law or in good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) detect, prevent, or otherwise address fraud, security or technical issues; (d) protect the rights, property, or personal safety of the digital platform’s users.
e. Reporting
Users are encouraged to report content that constitute or include cyberbullying, hate or any discrimination.
f. Termination
Users that use the site in an abusive manner will result in termination without warnings at the sole discretion of the web managers.
g. Feedback
You may, but are not required to, provide Voice for Change with ideas, suggestions, requests, recommendations or feedback about the platform. If you do so, you grant us a non-exclusive, royalty free, worldwide, perpetual, irrevocable license to use, reproduce, incorporate, distribute, and disclose any feedback for any purpose.
4. Limitation of Liabilities
We are providing you the digital platform along with our content and features and the opportunity that was based on the needs and dreams identified by the children and youth themselves. We cannot promise that there will be no risks of using the digital platform such as the app being totally free of viruses or other harmful components, will meet your requirements, be compatible, or work with any other software, applications,systems, error-free, or that any errors or defects can or will be corrected however we will do our best to minimise these risks. To the maximum extent permitted by applicable law, we cannot be held liable for any indirect, incidental, special, consequential or punitive damages incurred directly or indirectly from the use of the platform. Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of users, so some or all of the above exclusions and limitations may not apply to you.
